This document summarizes the key points of our Terms and Conditions for your reference. It is intended as a quick overview and does not replace the full Master Terms.
You agree to these Terms when you: Sign a quote, estimate, or work order from Honex, Receive delivery or installation of equipment, Submit payment or deposit, or Grant site access allowing Honex to begin work.
These Terms supersede any conflicting terms in your documents, including purchase orders or contracts, unless expressly agreed in writing. Digital acceptance via email or electronic approval is valid. By engaging our services, you acknowledge Honex’s vendor status; we supply materials and services and do not act as a subcontractor.
Invoices are issued upon acceptance of your quote or work order and are due immediately.Rentals automatically move to a month-to-month basis, with charges applied to your card on file each billing cycle unless otherwise arranged. Partial-month usage is not prorated. Late Payments: Late payments incur a 1.5% monthly finance charge (18% annually) or the maximum legal rate allowed by the service location. You are responsible for collection costs, including attorney fees and court costs. Taxes & Fees: Clients are responsible for all applicable taxes, permits, and regulatory fees. Reseller permits or exemptions must be submitted in advance; otherwise, sales tax applies. Conditional Payments: Payment marked as “paid in full” without covering the full balance does not waive your obligations. Guarantee of Payment: For business entities, the individual signing the agreement personally guarantees payment of all charges until fully satisfied. Material Costs & Change Orders: Materials are billed per your accepted quote. Additional materials or labor requested or required are billed at the same unit rates plus applicable service fees. Prevailing Wages: Clients are responsible for notifying Honex if prevailing wage rules apply and for supplying required project documentation for compliance.
Begins at delivery and continues until final pickup. Equipment remains Honex property. Restrictions: Equipment may not be moved, altered, subleased, or sold without written permission. Damage, Loss, or Theft: The client is responsible for replacement cost of damaged, lost, or stolen equipment. Weather & Wind: Clients assume responsibility for weather-related risks once equipment is delivered. Honex is not liable for tipping or damage caused by wind unless due to our negligence. Insurance: Liability coverage for rented equipment must be maintained by the client for the duration of the rental.
Standard fencing includes panels, metal t-stands, and clamps for installation within 30’ of delivery truck. Additional services such as land clearing, hand digging, core drilling, driven posts, patching, gates, or screening are available at extra cost. Hard surfaces may require weighted bases; windy conditions above 15 mph may require additional stabilization or service visits. High-Visibility Fencing: Standard 4’ poly fencing with wooden stakes every 10’; metal stakes available upon request. Clients are responsible for maintaining the fence during rental. Installation beyond 30’ or on slopes over 12 degrees may incur additional labor charges. Managed Services: Honex coordinates third-party vendors to provide: SiteGuard™ Surveillance: 24/7 cloud monitoring, trailer-mounted systems, solar power, AI alerts. Client responsible for site compatibility, data permissions, and compliance with local laws. Portable Restrooms: Optional servicing included; client responsible for trash management and damage. Temporary Office Space & Storage: Services coming soon; client responsible for damage and cleaning. Dumpsters/Roll-Offs: Services coming soon; client responsible for prohibited or hazardous waste. Honex coordinates logistics and serves as your primary point of contact. Vendor performance, maintenance, and outcomes remain the vendor’s responsibility. Honex is not liable for third-party service failures.
Client must provide a cleared work site with at least 30’ unobstructed access. Obstructions, underground utilities, difficult terrain, or limited access may incur additional charges. Hand-carry beyond 30’ or hillside installations over 12 degrees may incur extra labor. Installation & Removal: Dates are estimates based on crew availability. Honex is not liable for delays caused by weather, equipment failure, road closures, regulatory changes, third-party vendors, or acts of God. Wind-sensitive attachments or screened fencing may require rescheduling. Per Diem Labor Charges: Applied when crews work outside standard service areas or overnight, covering meals, lodging, and incidentals. Charges are per worker, per day. Property Damage: Honex is not liable for reasonable damage to surfaces, driveways, landscaping, or subsurfaces. Clients are responsible for patching and repairs related to driven posts or equipment movement. Permits & Utility Marking: Clients must obtain permits and mark all utilities. Honex is not liable for damage to unmarked or improperly marked utilities.
30 days prior: No charge, 7–30 days prior: 50% of deposit or quote After installation: No refund Storage: Delays 0–30 days: No charge. Delays >30 days: 20% of bid per month Termination & Repossession: Honex may terminate or repossess equipment if: Payments are overdue, Equipment is damaged or lost, Client breaches terms, Liens or bankruptcy actions arise. Repossession includes fees and costs; written notice provided 24 hours prior except in emergencies.
Clients defend and hold harmless Honex against claims arising from equipment use, except gross negligence or willful misconduct. Limitation of Liability: Honex’s total liability is limited to fees paid under the agreement. Equipment “As-Is”: All equipment is provided as-is, with no warranty on condition or performance. Insurance Requirements: Commercial General Liability: minimum $1,000,000 per occurrence, Property insurance covering rented equipment, Clients must list Honex as Additional Insured, provide certificates, and maintain coverage.
- Honex may correct errors in estimates or invoices, notifying clients within 7 days of discovery.
Washington State, Venue: Walla Walla County, WA, Mediation: Non-binding mediation required before legal action, Vendor Governing Law: Third-party vendors may have separate rules, Severability: If part of the agreement is unenforceable, the remainder remains valid.
